The Whipped Creamery

This Herdshare Agreement (“Agreement”) is entered into between The Whipped Creamery (“Farmer”) and the undersigned individual (“Member”) upon completion of enrollment and acceptance during checkout.

By purchasing a herdshare membership and completing checkout, Member agrees to the following terms:

1. Nature of the Herdshare

Member purchases a private ownership interest in the dairy herd owned and managed by The Whipped Creamery. This ownership interest grants Member the right to receive a portion of the raw milk and dairy products produced by the herd, made available exclusively through this private herdshare program.

This is not a retail sale of milk. All milk and dairy products are provided solely to herdshare members as a benefit of herd ownership.

2. Membership Fee

Member agrees to pay a one-time herdshare membership fee of $50 at enrollment.

This fee:

• Establishes Member’s ownership interest in the herd
  
• Covers onboarding, administration, jars, and record keeping
  
• Is paid one time only
  

Once enrolled, Member is a member for life unless this Agreement is terminated.

Milk and dairy products are not included in the membership fee and are purchased separately by pre-order.

3. Milk & Dairy Product Access (Pre-Order Only)

All milk and dairy products are offered by pre-order only, subject to weekly availability and herd capacity.

Member may pre-order:

• Raw A2A2 milk
  
• Member-only dairy products, including yogurt, buttermilk, bovre, cream, and chocolate milk
  

There is no standing order or monthly commitment required.

Member may order weekly or as needed.

Availability may be limited, and priority may be given to consistent ordering members when capacity is constrained.

4. Pickup & Drop Point Options

Member may select pickup or delivery at the time of each order:

Creamery Pickup

Available:

• Monday, Wednesday, or Friday: 8:00 AM – 6:00 PM
  
• Weekends: 10:00 AM – 3:00 PM
  

Pickup is free.

Drop Point Delivery

Available at designated weekly drop points throughout the Rogue Valley.

• Drop point schedules and locations are announced weekly
  
• A $5 delivery fee per order applies
  
• Drop point availability is subject to capacity
  

Member agrees to retrieve their order during the designated drop window.

5. Missed Pickups & Uncollected Milk

Member agrees to retrieve milk and products on the selected pickup or delivery day.

• Milk not picked up within two (2) days of availability may be removed or repurposed to make room for subsequent orders
  
• No refunds are offered for uncollected milk unless prior arrangements are made with at least 5 days’ notice
  
• Member may send a friend or family member to retrieve orders if needed
  

The Farmer is not responsible for storing uncollected milk beyond the two-day window.

6. Containers & Sanitation

Member is responsible for returning all jars clean and thoroughly washed.

The Whipped Creamery sanitizes all containers prior to refilling.

Failure to return clean jars may result in temporary suspension of ordering privileges until resolved.

7. Raw Milk Acknowledgment & Assumption of Risk

Member understands that:

• The milk and dairy products provided are raw (unpasteurized)
  
• These products are not inspected by the Oregon Department of Agriculture
  

Member acknowledges the potential risks associated with consuming raw milk and voluntarily assumes all responsibility and liability for themselves and their household.

Member agrees to notify the Farmer immediately if illness is suspected to be related to the milk so appropriate steps may be taken.

8. Personal Use Only

All milk and dairy products obtained through this herdshare are for personal use only.

Member agrees not to resell, redistribute, or share milk or dairy products outside of their immediate household.

9.Transport & Storage Reminder

Always transport milk on ice.

Store milk in the coldest part of the refrigerator.

Consume within 7–10 days for best freshness.

10. Termination

Member may terminate participation at any time by notifying the Farmer.

The Farmer reserves the right to suspend or terminate participation for failure to comply with this Agreement.

11. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Oregon.

12. Electronic Agreement

By completing checkout and enrolling in The Whipped Creamery herdshare, Member acknowledges that they have read, understand, and agree to this Herdshare Agreement. Member consents to conduct this transaction electronically and agrees that electronic acceptance constitutes a legally binding signature.
