The Whipped Creamery

1. Herdshare Ownership

Upon payment of the one-time herdshare membership fee, the Member purchases an ownership interest in the dairy herd operated by The Whipped Creamery (“the Farmer”) and becomes a part owner of said herd.

This membership establishes the Member’s legal participation in a private herdshare arrangement and grants access to raw milk and member-only dairy products produced by the herd, subject to availability.

The herdshare membership fee is $50 and is paid once. There are no monthly or recurring membership fees.

2. Nature of the Herdshare

The herdshare membership fee is not a purchase of milk. It represents the Member’s ownership interest and covers on boarding, administrative costs, record keeping, and jar management.

Milk and dairy products are made available to Members only by pre-order and are allocated based on herd capacity and weekly availability. Access may be limited, paused, or adjusted at any time to protect herd health and operations.

The Farmer retains full responsibility for the daily care, housing, feeding, and milking of the herd.

3. Ordering & Access to Milk

Milk and dairy products are available only to active herdshare members and must be pre-ordered in advance.

There is no standing or guaranteed weekly share. Members may place orders as needed, subject to availability.

Failure to place an order does not affect membership status.

4. Pickup & Drop Point Options

Members may choose from the following fulfillment options when placing each order:

Creamery Pickup
Members may pick up milk at the creamery during posted hours. Pickup times are subject to change and will be communicated in advance.

Drop Point Delivery
The Farmer may offer weekly drop points at select locations.

• A $2.50 delivery fee per order applies for drop point deliveries.
  
• Drop point locations, days, and availability are subject to change.
  
• Missed drop point pickups may result in forfeiture of the milk without refund.
  

Pickup method and location are selected at the time of each order.

5. Uncollected Milk

Members are responsible for collecting their milk during the selected pickup window.

If milk is not collected within two (2) days of the scheduled pickup or drop point, it may be disposed of to make room for future production unless prior arrangements have been made.

No refunds are offered for uncollected milk.

Members are encouraged to send a trusted friend or family member to retrieve milk if they are unable to do so due to illness, travel, or emergency.

6. Jar Responsibility

Members are responsible for returning all jars clean and empty.

The Whipped Creamery sanitizes all containers prior to refilling.

Failure to return jars may result in temporary suspension of ordering privileges until jars are returned.

7. Risk Acknowledgment & Assumption of Liability

Member acknowledges that raw (unpasteurized) milk may carry risks, including the potential for food borne illness.

Member voluntarily assumes all responsibility and liability for the consumption of raw milk and related dairy products by themselves and their household.

Member understands that:

• The milk is not pasteurized
  
• The milk is not inspected by the Oregon Department of Agriculture
  
• The milk is provided solely through a private herdshare arrangement
  

Member agrees to notify the Farmer immediately if illness occurs that is suspected to be related to the milk.

8. Personal Use Only

All milk and dairy products obtained through this herdshare are for personal household use only.

Member agrees not to resell, share, barter, or distribute milk or dairy products to individuals outside their household.

9. Termination

The Farmer reserves the right to suspend or terminate access for violation of this agreement or failure to comply with herdshare policies.

10. Governing Law

This agreement shall be governed and interpreted in accordance with the laws of the State of Oregon.

11. Safe Handling Guidelines

Members agree to follow basic raw milk handling practices:

• Transport milk on ice
  
• Store in the coldest part of the refrigerator
  
• Consume within 7–10 days for best quality
